1. Acceptance of these terms

These Terms of Service ("Terms") govern your use of the website at www.amavision.ai and the services offered by AMA Inc. ("AMA Vision", "we", "us", "our"), a company based in Houston, Texas, United States. By using the site, buying a package or AI service, or otherwise engaging with us, you agree to these Terms. If you do not agree, do not use the site or our services.

2. Services we offer

We offer growth packages (Foundation, Growth, Visionary), AI services (content automation, video avatar, voice receptionist, review manager, lead qualification, sales outreach), and one-time add-on services (website build, GEO + SEO setup, CRM setup, chatbot install, automation workflows, social profile setup) to small businesses. Specific deliverables, scope, and timing are described on the relevant section of the site and confirmed during your strategy call.

We may add, remove, or change services at any time. Existing customer engagements are honored under the terms agreed at the time of purchase.

3. Free strategy call

Most engagements begin with a free strategy call. The call is for us to learn about your business and confirm we are a good fit before any work begins. Adding a package or service to your cart is a request for an engagement, not a binding contract. The engagement is confirmed only after the strategy call and any payment we collect.

4. Payment terms

Setup fees and one-time charges

Setup fees and one-time add-on charges are due at checkout. Payment is processed through Stripe. We do not store your card details on our servers.

Monthly subscriptions

Packages and managed AI services include a monthly subscription. By checking the consent box at checkout, you authorize us to charge your card the stated monthly amount each month after a 30-day trial period, until you cancel.

Cancellation

You can cancel a monthly subscription at any time by emailing info@amavision.ai. Cancellation takes effect at the end of the current billing period. We do not pro-rate partial months unless required by law in your jurisdiction.

Packages have a stated minimum term (typically three months). If you cancel before the minimum term ends, you remain responsible for the remaining months in that term unless we agree otherwise in writing.

Refunds

Setup fees and one-time charges are non-refundable once work has begun. If you cancel before any work begins, contact us within seven days of purchase and we will refund in full. Monthly subscription charges are non-refundable for the current month but cancellation prevents the next charge.

Prices and taxes

Prices on the site are in US dollars and do not include taxes. You are responsible for any taxes that apply in your jurisdiction. We may change prices at any time; changes apply to new orders only and do not affect your current subscription rate for the remainder of the term you signed up under.

5. Deliverables and intellectual property

When we deliver work products to you (website code, content, designs, automations, copy), you receive a non-exclusive, perpetual, royalty-free license to use those deliverables for your business once you have paid in full. We retain ownership of underlying methodologies, frameworks, templates, and reusable tools that we use across multiple clients.

You keep ownership of any content, brand assets, and information you provide to us for use in your engagement. You grant us a license to use those materials only for the purpose of delivering services to you.

We may include you in our portfolio and reference your engagement in marketing unless you tell us in writing that you prefer not to be listed.

6. Your responsibilities

• Provide accurate information about your business and your goals.
• Make decisions and provide feedback in a timely manner so we can deliver.
• Grant the access we need to your accounts (website, social platforms, CRM) for the work to proceed. We will only request access we genuinely need.
• Ensure that any content, images, or claims you provide are legal and do not infringe anyone's rights.
• Comply with applicable laws (advertising, privacy, professional licensing, etc.) in your industry and jurisdiction.

7. Acceptable use

You agree not to use the site or our services to:

• Violate any law or regulation.
• Send spam, harass others, or distribute malware.
• Infringe the intellectual property rights of others.
• Attempt to gain unauthorized access to our systems or accounts.
• Resell our services as your own without a written agency or partner agreement with us.

We may suspend or terminate your engagement for serious or repeated violations.

8. AI services and disclaimers

Our AI services use third-party AI tools and models. The outputs may be inaccurate or incomplete. We test and refine outputs, but you are responsible for reviewing them before publishing or acting on them, especially for legal, medical, financial, or regulated industry content. We do not guarantee any specific business outcome from using AI services.

9. Disclaimer of warranties

The site and our services are provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the site will be uninterrupted or error-free, that defects will be corrected, or that any specific result will be achieved.

10. Limitation of liability

To the maximum extent permitted by law, AMA Inc., its founders, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly, arising from your use of the site or our services.

Our total liability for any claim arising from these Terms or our services will not exceed the total amount you paid us in the twelve months before the event giving rise to the claim.

11. Indemnification

You agree to indemnify and hold harmless AMA Inc., its founders, employees, and contractors from any claims, losses, damages, or expenses (including reasonable legal fees) arising from your breach of these Terms, your misuse of the services, or your violation of any law or the rights of any third party.

12. Governing law and disputes

These Terms are governed by the laws of the State of Texas, United States, without regard to its conflict-of-laws principles. Any dispute arising from these Terms or your use of the services will be resolved exclusively in the state or federal courts located in Harris County, Texas. You consent to the personal jurisdiction of those courts.

13. Changes to these terms

We may update these Terms from time to time. The "Last updated" date at the top shows when the most recent change was made. For material changes, we will notify active customers by email. Continued use of the site or services after a change means you accept the new Terms.
